ARTICLE 1: SCOPE AND PURPOSE
These General Terms and Conditions of Sale (GTC) apply to all jewelry sales concluded on the Atelier's website. They define the rights and obligations of the Atelier and its Client. Any order confirmed by payment of a deposit or the full price implies unreserved acceptance of these terms.
ARTICLE 2 : DISTINCTION OF PRODUCT TYPES
The Client expressly acknowledges the existence of two types of services within the Atelier:
-
Products in Stock (or Showcase): Jewelry already crafted and available for immediate sale.
-
Unique Orders (Custom-Made): Original creations made according to specific specifications or requiring the sourcing of particular gemstones.

ARTICLE 3 : PRODUCTION AND DELIVERY TIMES
In accordance with the technical requirements of Fine Craftsmanship, delivery times are defined as follows:
-
Products in Stock: Shipped within 2 to 10 business days after receipt of full payment.
-
Unique Orders and Exceptional Creations: Due to the complexity of hand-forging and sourcing rare gems, the production time is between 3 months and 2 years.
The specific estimated timeframe for each project is always indicated on the quote or order form signed by the Client.
ARTICLE 4: ORDER AND DEPOSIT TERMS
For all Unique Orders, the sale is considered final only after signature of the quote and receipt of a deposit.
The deposit allows for the commencement of gemological research and the initial stages of production.
In the event of cancellation of the order by the Client during its execution, the deposit will be retained by the Workshop as compensation for the work and materials used.
ARTICLE 5 : PRICE AND FLUCTUATION IN METALS
Prices are expressed in Euros, including VAT.
For long-term orders (over 6 months): The Workshop reserves the right to adjust the final price in the event of a major fluctuation (over 10%) in the price of Gold or Platinum between the signing of the quote and the casting of the piece. The Client will be informed before the manufacturing stage.

ARTICLE 6 : NO RIGHT OF WITHDRAWAL
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized.
Consequently, Unique and Custom Orders are neither exchangeable nor refundable.
ARTICLE 7 : SECURE DELIVERY AND TRANSFER OF RISK
The Atelier ensures the shipment of jewelry via a specialized carrier (Declared Value) with insurance covering the actual value of the item. The risk of loss or damage is transferred to the Client upon receipt of the package or its delivery in person to the workshop in Léognan.

ARTICLE 8 : INTELLECTUAL PROPERTY
The Atelier retains the intellectual and artistic property rights to its designs. Any reproduction, copying, or use of a design or a unique piece of jewelry without written consent constitutes infringement and may be subject to legal action.

ARTICLE 9 : APPLICABLE LAW AND DISPUTES

These Terms and Conditions are governed by French law. In the event of a dispute, and after an attempt at amicable mediation, the courts of Bordeaux shall have exclusive jurisdiction.
